中国一艘渔船遭阿根廷海岸警卫队击沉

据中国国际广播电台Beijinghour报道，阿根廷巡逻艇击沉中国渔船。An Argentinean coastguard vessel fired on and sank a Chinese fishing boat in waters near Puerto Madryn， local media Clarin said on Tuesday。

　　（据当地媒体周二报道，阿根廷海岸警卫队船向一艘中国渔船开火，中国渔船在临近马德林港海域沉没。）

　　另据香港凤凰卫视报道 被击沉渔船涉嫌非法捕捞

　　中国一艘远洋渔船涉嫌在南美阿根廷水域非法作业捕鱼，日前遭到阿方海岸警卫队开火击沉，船上人员获救。

　　涉事的渔船名为“鲁烟远渔010”，根据阿根廷海岸警卫队发放的片段，警卫队巡逻船在马德林港附近水域跟渔船展开追逐。

　　警卫队指出，渔船在逃向国际水域期间，多次试图撞向巡逻船，对双方都造成危险。阿方多次用无线电联络以及向天开火示警，希望登船搜查，但渔船方面未有理会。巡逻船最终向船身开火，船员即时弃船跳海，四人被巡逻船救起，其他人被另一艘中国船救起。当地媒体称，当时中国渔船上有30多名船员。

　　阿根廷外交部表示，司法机关正在调查事件。

是應該譴責. 這種作法其實是違反國際慣例.

我翻出早期聯合國海事法庭(ITLOS)的判例, 清楚的顯示,
一般慣例是不主張過度使用武力.

以當年英國(蘇格蘭)拖漁船 Red Crusader在Faeroe Islands
非法捕漁的判例, 丹麥驅逐艦Niels Ebbesen因Red Crusader逃走而開火.


其判例節錄(4), (5)如下:
(4) that,  in  opening  fire  at  03.22  hours  up  to  03.53  hours,  the  Com
-manding Officer of the “Niels Ebbesen” exceeded legitimate use of armed force
on two counts:
(a) firing without warning of solid gun-shot;
(b) creating danger to human life on board the “Red Crusader” without
proved necessity, by the effective firing at the “Red Crusader” after 03.40
hours.

The  escape  of  the  “Red  Crusader”  in  flagrant  violation  of  the  order
received and obeyed, the seclusion on board the trawler of an officer and rat
-ing of the crew of “Niels Ebbesen”, and Skipper Wood’s refusal to stop may
explain some resentment on the part of Captain Sølling. Those circumstances,
however, cannot justify such a violent action.

that the cost of the repair of the damage caused by the firing at and
hitting of the “Red Crusader” submitted by the British Government has been
considered reasonable by the Danish Agent.

這些本應是處理這種事情的最高原則.

再舉一個saiga 判例


"....Although  the  Convention  does  not  contain  express  provisions  
on the use of force in the arrest of ships, international law, which
is applicable by virtue of article 293 of the Convention, requires
that  the  use  of  force  must  be  avoided  as  far  as  possible  and,  
where  force  is  unavoidable,  it  must  not  go  beyond  what  is  rea-
sonable  and  necessary  in  the  circumstances.  Considerations  of  
humanity  must  apply  in  the  law  of  the  sea,  as  they  do  in  other  
areas of international law..."

簡單的說, 儘量不用武力, 要用也要reasonable and necessary.
人道(humanity)也是最大的考量!

**啥是reasonable and necessary
Craig H.Allen有提到...."unless the pursued vessel fires upon the
enforcing vessel" 查証: d.o'connell supra note 21.
在逃的漁船沒用開火攻擊下, 追擊方也應避免採用武力開火手段.


ITLOS也在判列說:
The  inspecting  State  shall  ensure  that  its  duly  authorized  
inspectors [...] avoid the use of force except when and to the de-
gree necessary to ensure the safety of the inspectors and where
the inspectors are obstructed in the execution of their duties. The
degree of force used shall not exceed that reasonably required in
the circumstances.
除非執法人員在執法時, 安全受到侵害, 方可使用武力.

另外, 查証
Of relevance is also the 1988 Convention on the Suppression of
Unlawful Acts of Violence against the Safety of Maritime Naviga-
tion, as revised by a protocol from 2005,19
whose article 8bis(9) states that:
When carrying out the authorized actions under this article, the
use of force shall be avoided except when necessary to ensure the
safety of its officials and persons on board, or where the officials
are  obstructed  in  the  execution  of  the  authorized  actions.  Any
use  of  force  pursuant  to  this  article  shall  not  exceed  the  mini-
mum  degree  of  force  which  is  necessary  and  reasonable  in  the  
circumstances.
