公司迟迟不发薪水

我薪水有超过rm1500也是在劳工法令保护下?真烦恼 ,请多多帮忙,谢谢

Question:
Would like to enquire after an employee resigned & left the employer/company, the employer/company should pay the employee last salary payment within how many days? (Assuming the employee is released from the resignation & no pending matters)
Note: Employee monthly salary is above RM5,000

If you want to use the Employment Act (which does not cover the employee concerned) as a guidance, it is on the same day.
Question:
Apart from Employment Act which does not cover the employee concern, is there any other options/guide can be used by the employee to seek payment from employer within a period of time? As the employer did not execute payment to the employee according to the salary payment date stated in HR policy.
Employee last working day - 16 June
Employer salary payment date (according to HR policy) - 23rd of every month
Answer:
I am not aware of any other laws. If your former employer has any reason to withhold or not wanting to pay your salary, you may have to sue for it in court.
另一个case
Question:
I have tendered my resignation on Jan 09 and last day should be Feb 09, hoever the company wrote to me officially to request me to stay on for another 2 months which i did not reply officially but verbally. Therefore my last month of work is supposed to be April 09. The company releases the salary in two batches each month once on the 15th and the other at the end of the month. I notice today that my salary isn't in and i ask hr, i was told that because of my resignation my salary is being hold for one month. Is this legally right? i have given them prior notice in accordance to my contract and they were the one who requested me to extend.
by the way my salary is above 2500

Didn't they tell the reasons for withholding your salary for one month? If they still did not pay you after one month, you may complain to the Labour Department.
Question:
they did not say specifically but they say just to make sure that everything is proper before they release my salary, however do they have the right to hold even for a month because the law cites that
The wages, less lawful deductions, earned by but not yet paid to an employee whose contract of service terminates in accordance with section 11(1) or of section 12 shall be paid to such employee not later than the day on which such contract of service so terminates.

Yes, you are right. You have the right to complain right now if you don't feel like waiting.
我的意见就是如果你的薪水超过2000, 一却以offer letter 为准。 如果offer letter 没有写他可以withhold 你的薪水, 你可以投诉给劳工局问下他们意见。 注意:
Mulai 1 April 2012, Gaji Pekerja yang dilindungi adalah sehinggan RM2000 sebulan (Tidak termasuk pekerja 'manual' yang tiada had gaji)

Aduan yang dikendalikan oleh JTK adalah :

Telefon ke talian telekerja JTK (senarai telekerja)
Emel rasmi Jabatan Tenaga Kerja Semenanjung Malaysia.
Untuk mempercepatkan tindakan terhadap Aduan Perburuhan, pengadu (Majikan/ Pekerja) perlu hadir sendiri ke Pejabat Tenaga Kerja bersama dengan dokumen yang diperlukan. Setiap aduan akan di kendalikan oleh Pegawai Buruh Terlatih di Pejabat Jabatan Tenaga Kerja mengikut kawasan tempat pekerjaan.

Kad Pengenalan/ Pasport
Surat Lantikan/ Kontrak Perkhidmatan
Slip Gaji/ Slip Bayaran Upah
Kad kedatangan
Surat Tunjuk Sebab/ Surat Penamatan Kerja (Jika berkaitan)
Dokumen lain yang berkaitan kontrak penggajian.
