如果你们是我。。你们会采取什么行动?

大家好。。首先我要先说明我是马来西亚人。。
可是目前在新加坡工作。。
之前被前公司无理扣了四百多块新币。。
详情可以看看这封我写给MOM的内容:

I was under the employment with xxx from 1st July 2010 to 26th July 2010.
On 23th July 2010, I was not feeling well due to menses cramp and had informed
the Company that I will be on medical leave on this day; however, I was really
feeling unwell and did not manage to consult doctor since I still have some
pain killer that was given by doctor previously (you may contact Healthway
clinic, Jurong West for verification). I assumed that this day of absence will
be treated as Unpaid Leave (as I was still in probationary period).
I have tendered my resignation with Cxxmxxl Chemical Corporation Pte Ltd
on 12th July 2010 and my last day of service with them was on 26th July 2010.
My 2nd pay salary for the month of July 2010 is still outstanding as of today
(This co pay salary twice a month).
On 28th July 2010, I received a call from the HR personnel from Cxxmxxl
Chemical Corporation Pte Ltd , informing me that the day of absence on 23th
July 2010 will be regarded as unpaid leave, coupled with an additional
deduction of another 3 days' salary (therefore, 4 days' salary will be
deducted), reason being, as per their company policy, leave shall be applied 1
week in advance & I failed to provide MC proof on time.
我被扣除的四天是那么算的:
1.) 1 day unpaid sick leave
2.) 1 day Resignation notice in lieu as per MOM.(我问了MOM他们说我照理由是要做到23号而不是26号的。。那么我还做多一天给他们呢。。)
3.) 2 days for contractual breach as agreed under the employment contract and condition of leave.(没注明。。只说拿假要一个星期的通知而已)
有一天是我缺席的一天我也认了。。。
S PASS的申请费。。两年费用。。。MEDICAL CHECK UP。。总共百多。。我付,我认了。。。
可是他们扣除的其他的呢, 我就真的是很不服很不服。。。
根据我的APPT LETTER,如果我要拿AL的话要一个星期前通知
虽然我没去拿MC PROOF是我的一大失策。。
可是很多人也说:既然还在PROBATION那么拿AL或EL还是MC也没有差别啊。。
我之前在那烂公司还做天天做到很夜TIM....到半夜那样。。然后还时常忙到下午五点才吃午餐。。半夜才吃晚餐。。

我的另一同事。。算是我的助理吧。。也是马来西亚人。。也是在我丢信后的一个星期丢信
有一天也是不舒服拿MC。。然后我公司处理HR事务的那人可能今早跟我讲了我的情形。。
然后也好心地来电她。。叫她去公司的PANEL CLINIC看医生不然就可能如我似要赔四天工作日了。。
可是我那同事居住在JB。。没道理要她发高烧然后来到新加波看医生然后再回去的吗?
再说。。公司也不可能帮我们付医药费的啦。。
然后她也一样被扣四天。。
当初她拿假后的第二天还有亲自跟老板说。。老板说会考虑。。
我说做决定的是老板。。他还要考虑什么WOR。。
最后还是会扣你的吧。。最后果然也被扣四天。。。 |

混账公司!!!
套句别人说的话。。那么大间的公司。。
看不出会那么吝啬的。。。。那么过分的。。
他们跟MOM说因为我是EXECUTIVE LEVEL..
所以不在MOM的保护之下。。。
还说我有DECISION MAKING的能力。。
屁话。。。什么价钱的问题全部还不是要过问老板。。。
然后一毛钱也不愿意付。。不打算和解。。。法庭见。。。。

我在找些HR、法律的朋友帮我看看目前的胜算有多少。。
就是在找证据证明我不是EXECUTIVE LEVEL没权利下决定等等。。
可是我上头的人直对就是老板了。。有点他说完的感觉。。。
再来就是没理由还在工作的同事会帮我讲话。。
已经离职的是不想惹这些麻烦事。。。
就算有个跟我一样被扣那么多的。。
可是她也就认了。。。当自己倒霉咯。。。 |

23/7星期五拿假。。。26/7拜一走人。。
我没填任何的LEAVE FORM。。
29/7 HR打电话来问我那天有没MC纸?
我说没有后就赶紧接着说老板说要扣我四天。。。
11/8去MOM见OFFICER谈论这案情。。
12/8 HR打打电话要求我FILL IN LEAVE FORM。。
可是当问起REFUND或REDUCTION的时候没给予任何回复。。
之后MOM的人打来。。然后HR也打来。。
我就跟HR说既然你们已经扣我4天了。。
那么我也不想浪费我的时间精神特地去一个地方然后填这个FORM了。。
HR直接跟我说你跟老板斗没好下场的。。
老板权势很大的。。不然哪有如今那么大的公司。。。
老板也很爱面子的。。情愿花了几千去告你什么的。。
叫我乖乖地填了那个FORM......
这样算语带威胁吗???? |

不确定马来西亚跟新加坡是不是也走着相同的BRITISH LAW???
Who is covered by the Employment Act
covers every employee (regardless of nationality) who is under a contract of service with an employer, except: - Any person employed in a managerial or executive position
Managers & executives
Managers and executives are employees with executive or supervisory functions. These functions include the authority to influence or make decision on issues such as recruitment, discipline, termination of employment, assessment of performance and reward, or involvement in the formulation of strategies and policies of the enterprise, or the management and running of the business.
They also include professionals with tertiary education and specialised knowledge/skills and whose employment terms are comparable to those of managers and executives. Professionals such as lawyers, accountants, dentists and doctors whose nature and terms of employment are comparable to executives would generally be deemed as such, and hence they would not be covered under the Act.
Junior managers and executives earning $2,500 basic monthly salary and below are only covered partially on the basic payment of salary. All other provisions do not apply to them.
cover partially指的是哪一部分?
不过我懂unauthorize deduction这部分肯定没cover到。。。 |

Reporting a Breach of Terms and Conditions under the Employment Act
The Ministry of Manpower looks into complaints filed by employees who are covered by the Employment Act。Managers and executives earning $2,500 basic monthly salary and below are covered for the purpose of salary payments, but the other provisions of the Act do not apply to them. If you are not covered by the Act, you may wish to seek a lawyer's advice on pursuing the matter in the civil court.
我薪金两千出。。
可是MOM的人说不是看薪金而是看你的JOB SCOPE来定你是不是EXECUTIVE LEVEL。。
不过我的APPT LETTER注明我是MARKETING OPERATION EXECUTIVE..
S PASS的TITLE则是MARKETING EXECUTIVE。。。
那我这点的话是不是输定了啊?
如果我要反驳的话。。。我该说点什么才好?
我感觉我做的东西纯粹是一个SALES CO的范围。。就COORDINATE而已。。。
完全没做决定的空间。。。加上我刚进去12天就丢信了。。。 |

400 块真的有点多,难怪你会告。不过是我,我会放弃,因为我的经济不允许我这么做,手停口停,动不动就上法庭,新公司会留下不好的印象。可能你的前公司就是抓住这一点,看死你不会告。 |
