	王律师我想问你一点东西 如果一个人在被控告15(1),12(2)的情况下 第一次上法庭还没有被保释就认罪了 但是report还没有出来。不能倒案。 法庭让他保释，排期28/4上法庭 那个人如果在28/4否认会怎样？

被控告什么罪？拥毒和吸毒？
如是， report还没有出来， 通常会 postpone
有report才可以判

Dangerous Drugs Act 1952

12(2) - 拥毒
         - 判     :-  1) 罰款不超過 RM20,000.00, (好像改去RM100,000.00)<== 已经改了或

                        3) (1) 和 (2)

15(1)(a) -吸毒
         - 判     :-  1) 罰款不超過 RM5,000.00, 或
                        2) 坐監不超過 2 年, 或
                        3) (1) 和 (2)
12(2) : Possession of Drug
Nature and consequence:
- shall be liable on conviction to a fine not exceeding *one hundred thousand ringgit or to imprisonment for a term not exceeding **five years or to both.
-  Any person who is a public officer employed at any prison, rehabilitation centre, police lock-up or place of detention shall, on his conviction under subsection (3) for contravening subsection (2), be liable to whipping of not more than three strokes in addition to the punishment to which he is liable under subsection (3).

15（1）（ a）Self administration : shall be liable on conviction to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding two years.
还有在  section38B 之下守刑。
(1) Where a person is found guilty of an offence under section 15, he shall, immediately after having undergone the punishment imposed upon him in respect thereof, undergo supervision by an officer as defined under section 2 of the Drug Dependants (Treatment and Rehabilitation) Act 1983 for a period of not less than two and not more than three years as may be determined by the court.
