Defence Minister Ng Eng Hen said Mindef ‘should waive the costs to the family’

Did Mindef give in to public pressure?

In a Facebook post late on Monday night, March 7, 2016, Defence Minister Ng Eng Hen said that the Ministry of Defence “should waive the costs to the family” of Private Dominique Sarron Lee who filed a civil suit.

He said he has informed Mindef and the Singapore Armed Forces staff.


This post came merely nine hours after the SAF’s clarifications on Facebook regarding the tragic case of the late Private Lee, who died in 2012 from an allergic reaction to smoke grenades during a military exercise.

In SAF’s post, they reminded Singaporeans about the key findings from the Committee of Inquiry (COI) in 2012 and the Coroner’s Inquiry (CI) in 2013, and revealed how they supported Lee’s family.



Court case dismissed

The case, which occurred nearly four years ago, came into prominence after its recent hearing in High Court (March 3). The High Court dismissed the lawsuit brought against the SAF and two of its officers by the family of Private Lee.

According to a widely circulated letter by Felicia Seah, Lee’s mother, the court ruled that the family has to pay for the legal costs of $22,000 to the three defendents.



Ng’s reasons for waiving the costs

Ng defended the High Court judgement, saying that it was based on sound legal grounds and precedents.

However, he added that Mindef “need not add to the pain and anguish of the family of the late PTE Lee”.



But the timing of two Mindef posts in one day will raise some questions

After all, it took Mindef five days to finally clarify and restate its previous positions on the case.

Perhaps 10.45pm is the peak timing for Singaporeans surfing online, but it is uncharacteristic for a Minister to announce an important decision at such a late hour on Facebook, after the media’s off stone time.

During these past five days, Seah had penned a letter, met Singapore Democratic Party leader Chee Soon Juan and a Singaporean had already launched a fundraising campaign to defray the legal costs Lee’s family incurred.

Let’s hope that the negative public opinion was not Minister Ng’s key consideration in making the decision.

Or we will have many public trials by social media in future.

This is what opposition parties in Singapore are good for: Avenue of last resort.


Chee Soon Juan, leader of the Singapore Democratic Party, has met up with the mother of the late full-time national serviceman, Private Dominique Sarron Lee, 21.

This was after the High Court on March 3, 2016, dismissed the lawsuit brought against the Singapore Armed Forces (SAF) and two of its officers by the family of Private Lee.

In the closed-door hearing, all three defendants had applied to strike out the claim on the grounds that there is no reasonable cause of action and that the suit is frivolous, vexatious and an abuse of the court process.

The defendants had argued — in a line of defence that relied on this provision in the Government Proceedings Act — that they are indemnified from being sued for negligence for deaths and injuries if the acts are certified to be attributable to service.

Private Lee died in 2012 from an allergic reaction to smoke grenades during a military exercise.

His family filed the civil suit in 2015.

In a Facebook post, Chee wrote that it was the mother, Mdm Felicia Seah, who approached him:


A few days before this meeting, Mdm Seah had penned an open letter to her late son lamenting that she has not found closure and was ordered to foot the legal costs of the other parties as a result of her failed suit.

Chee said the Ministry of Defence and the Singapore Armed Forces have much to answer for, as the SDP will study the matter and make a statement in the near future.

Dominique Sarron Lee’s family clarifies no compensation amount accepted, SAF & Mindef never apologised to them


Family wants Mindef to reveal the compensation sum.


Dominique Sarron Lee’s family has responded to yesterday’s FB postings by Defence Minister Ng Eng Hen and the Singapore Armed Forces (SAF).

The family of the late Private Lee, who died in 2012 from an allergic reaction to smoke grenades during a military exercise, wanted to clarify their positions.

This was after SAF told the public yesterday that it tried to help NSF’s family, punished the two officers involved and have made improvements to training safety regulations.

Minister Ng also told the public that Mindef should waive the legal costs that Lee’s family has to pay, after the family lost their civil suit against the organisation and the two officers.

However, chief among the clarifications Lee’s family wished to make include:

1. Mindef/ SAF actually did not apologise formally to the family until yesterday’s FB post:

According to the family, the Facebook post by SAF yesterday (March 7) was “the first statement of apology from MINDEF”. The family said that a MINDEF representative told them that the Minister or any senior official “will never apologise for the incident”. The family’s request for MINDEF to pay for Lee’s tomb was rejected due to legal constraints.


(Editor’s note – In fact, Minister Ng apologised to the families of Lee during his 2012 Ministerial statement, adding that the “SAF and MINDEF are deeply sorry for the untimely and tragic loss of PTE Lee” and the anguish and distress it has brought to their families).

2. Details on how the two negligent officers have been dealt with were found wanting:

The family said that Mindef/ SAF has yet to address the family’s question on whether justice was done.

The family clarified that they were not out to persecute the two officers but felt that it was “contradiction of the assurances by MINDEF/SAF that the negligent officers have been duly dealt with”, especially if a Facebook posting that one of the negligent officer was promoted turned out to be true.



3. Civil suit “never been about money”:

Family would not have taken the legal route had Mindef been fully “committed to assisting and providing” the family with answers they seek.

The family had rejected offers from Mindef/ SAF to discuss monetary compensation. The family only accepted a funeral grant to defray the cost of the funeral, which according to the SAF, is not part of the compensation.



4. Mindef’s conclusions from the findings of the Committee of Inquiry (COI) and the Coroner’s Inquiry (CI) were unclear:

The family said that CI was to ascertain the cause of death and “does not determine whether or not the 2 officers or MINDEF is/are culpable or not”.

But Mindef’s interpretations from the CI were unclear:

Defence Minister, in his Parliamentary Statement in November 2012, stated that the COI concluded that the two officers were negligent, but yesterday’s Facebook statement by SAF stated that the COI “did not find that the two officers were directly responsible for PTE Lee’s death”.
