5 % retention

有个问题， 问了不少人都没有肯定的答案。。。consultant and experience QS also cant give a firm answer.so i think friend over here can help or atleast we try to get the answer.

the 5 % retension on contract sum is base on
1. original contract sum
2. contract value to date
3. contract value to date ( included all variation order to date)
4. estimated final sum

case 1 .（NO VARIATION ORDER/ ADDITIONAL COST)

lump sump contract, original contract sum is rm 1000, contract period is 10 month , contractor claim every month base on % of work done. let's say during claim no 5 , contractor claim 55% ,and QS consultant verified 55% work done, so the amount will be （rm1000 * 55%) then less the 5% of contract sum.( 10% of workdone amount more then 5% of contract sum, so take the lesser one) . payment will be =  RM500.00

Case 2.(WITH VARIATION / ADDITIONAL COST)
Lump sump contract , original contract sum is rm 1000, during 5th claim, contractor claim 55% + variation order (+) rm80.00 , so the amount for payment will be ......

(rm1000 * 55%) = 550 + 80 = 630 . less the 5 % retention of........

1. original contract = 630 - 50 = 580 ?
2. contract value up to　date = 630 - 54 = 576

如果ＶＡＲＩＡＴＩＯＮ　（－）有５０－６０％，　还继续RETENTION ON ORIGINAL CONTRACT 的话，　ＣＯＮＴＲＡＣＴ　会吊颈了吧。。。。。

我遇到的问题就像这样，　要解决不难，　但正确的答案是什么？　因为大家NORMAL PRACTICE D都不一样。帮帮忙，几千万或几亿的PROJECT 影响很大。。。。我有个ＰＲＯＪＥＣＴ　的ＶＡＲＩＡＴＩＯＮ　ＯＲＤＥＲ　（＋）ＡＢＯＵＴ　２０％，　ＴＨＥＲＥＦＯＲＥ　ＴＨＥ　ＣＯＲＲＥＣＴ　ＷＡＹ　ＷＩＬＬ　ＡＦＦＥＣＴ　ＡＬＯＴ　ＯＦ　ＴＨＥ　ＦＩＮＡＬ　ＡＭＯＵＮＴ．

如果可以，　请把你们在处理这类问题时的经验分享下。。。。

除非，有limit of retention sum。。。
那么到了那个limit就没有extra retention。。。

我公司的做法是：
不管你的contract sum是多少(lump sum也好，contract value to date，还是final estimate work done)，
progress claim total amount (include vo + total work done to date) * 5% 就是你的
retention，不过不同公司有不同做法吧？
我个人觉得最好有一个retention limit，比如说5% of contract sum，看哪一个比较少，哪一个就当作retention。( 这是我公司所有contract都有的，不然给人家扣到工钱都给不起就糟了 ）
还有别人的公司有不同的做法吗？

retention monie = max 5%(unless stated otherwise,) of REVISED contract sum.

if the orig contract sum is 100k.during progress of work, m.c given instruction which contribute a vo amounting to 10k,that means at this moment,max retention will be based on 110k. unless this contract got vo omission, n the q.s revised this contract amount,then this will reduce the retention. otherwise the retention stil based on 110k.
if at the end of project, the final contract sum reduce to 90k,the extra deducted retention will only be released in this final cert.

During work progress, all workdone certified, including of material on site certified,r subjected to retention.

release of retention, follow cidb standart contract; 2.5% after cpc; another 2.5% after dlp/cmgd. it depend on the contract binded.

最公平的是跟据 Adjusted Contract Sum，也就是 :

5% x (original Contract Sum ± VO)

同意，但contractor 不会轻易同意， 要花不少时间谈了， 还有， 连 consultant 都没有standard 的....而且一至说：一向来都是这样的。。。。contractor 这样说就算了， consultant 这样说很不负责任。。。。。。

我以前的公司（Q。S Firm）做contract 是写明5% of retention sum or revised contract sum whichever higher. 所以过后没得argue。

现在的公司（Contractor）没说明。
so 我的做法（对sub-con）也是那样。
但对client 我说---写明是based on 5% of contract sum， 那里可以随便改。

我也是QS,但恕我用英文来写..

It really depends on which forms of contract you use. In general, it is 5% of the original contract sum (let say 100K, take 20wks to complete). In every month, your certified value will be deducted with 5% retention.

In the case of variation (if cost and EOT are agreed, which is 10K and 10 days EOT), then the original contract value will be adjusted to 110K, and the revised construction period will be 20wks 10 days.

Therefore, if your certified value is 20k + 10K (due to variation) = 30K, then your retention value is 5% of 30K.

If you using standard forms of contract, like PAM, NEC, etc, there should have a clear defination to this.

30k over 110 k 因该是10% retention 阿。因为10% of workdone up to max of 5% of contract value 阿。 但是我的几个contractor 常常扮蒙， retention 早早就放5%, 我correct 时就嘻嘻嘻的笑，hahaha,那他们没有办法。。。。。我没有pam and cidb 的contract form, 有大大有softcopy 吗？？

这个就depends on 你的forms of contract 了。在NEC里，没有所谓的10% over value, max 5% of contract amount，它就是直接5% over the value certified.
PAM form 好像是10% retention, max 5% contract sum.对吗？

行情不好， 省！！！！！！！！再省!!!!!!!!!! （那里买？？多少钱啊？？复印的可以吗？？) 我又去过一个seminar 是讨论Pam form 的contarct and clause 的， lawyer 来讲， 那时刚刚学做claim, 差一点听到死掉。。。。不过吃两个tea 和一个lunch, 饱！！！哈哈，很废哦。。。。。。。。要翻书了， 看看那时有送吗。。。。。

hehe。。。是听说教听到很显吗？

Lawyer他们哪里了解construction的？他们只是interpret clause而已。

PAM form去library找找看有没有咯。至于复印嘛，偷偷印一份是没问题的。。
