买屋子,对方律师不交出锁匙

事情是这样的,对方律师过来一封信说我们因为late payment,要交还400多块的interest,才可以给我们锁匙
我的律师说这个late payment不是因为我们而造成的,所以我们不需要还。。。
就这样,你一封信来,我一封信去,已经超过3个working days的限期交锁匙。。。
还有,我的snp的屋价是make up的。
问题:
1, 不管是谁的错,我可以在超过3天的交锁匙的限期过后claim对方8%interest吗?8%是看make up的,还是实价?(我律师是说可以,那如果argue到来,是我们错也可以claim吗?)
2, 既然屋子的钱都交清了,只剩下交锁匙给我(锁匙在对方律师那里),我已经等得不耐烦了,可以直接找锁匠直接开门吗?
3, 我们还有RM13,100的balance (因为make up 屋价)在对方律师那里,也可以claim interest吗?
4, 就因为400多块,律师有权扣留我的家锁匙马?因为屋子是我的名字,屋期也是我在还。

agreement 有说你能charge 8% interest ?

除非你很可定你没late payment, 那么你可以叫你的律师write to them, give them notice that if they fail to furnish you with the house key, they are to be held fully responsible for whatever costs incurred as a result of their breach in the event, it is proven that your payments were all on time and that there was no such late payment, as alleged.
3, 我们还有RM13,100的balance (因为make up 屋价)在对方律师那里,也可以claim interest吗?
应该不能,除非合约有写
但是通常不会有balance 的
因为当你在买屋子是
卖家会签set off letter , 也是说,mark up price difference , 会从deposit 那里扣除,你就不须给full deposit price
不明白为什么你没有那么做
4, 就因为400多块,律师有权扣留我的家锁匙马?因为屋子是我的名字,屋期也是我在还。
应该可以,因为400: outstanding sum... until full payment is received only the seller fully exhausted his legal rights to claim against you. |

如果是大家的错,就不可以charge
除非你很可定你没错
(有,snp有些明,有没有错的问题,是律师很肯定告诉我,late payment不是我方问题,不需要我负责这笔钱)

u can lodge a complaint to the bar council
whether 可以找锁匠开锁吗?- this i am not too sure, as payment is still not fully made yet, that is, RM400.00 allegedly outstanding.

then u should get ur lawyer settle everything for us, as it was their fault, making full payment to seller's lawyer, despite knowing the arrangement.

真的很谢谢你所有的回复
我的律师还是没有找到对方律师的“真身”,全部都是clerk或者staff转告的,也还没有verify的
他们的clerk是说看了那封信是没有问题,应该明天会把锁匙交去我律师那里,如果没有问题。。。
我的律师说,拿到锁匙,我们再claim回8%的interest。。。
还有问你一下,至于claim 8% interest,我的律师会跟我再收费吗?因为这些条件都在snp的。。。 |

depending on your lawyer.
normally they should not charge u if the amount is small. it is very subjective, you better check with your lawyer.

真的是没完没了。。。。
今天拿了锁匙,可以对方律师在没有同意之下,擅自扣除400多块。。。
我的律师写回了信件,说我们完全不同意那个late payment的款项,叫他3天之内退还。。。
我的律师建议我拿不到钱,就入拼small claim court, sue seller,并且偿还超过3天期限的赔偿,总共600多块
请明白我不是找麻烦,原因是我没有错,为什么要还钱呢?

然后昨天,对方的律师没有经过同意直接把400+从我的balance (mark up balance)扣掉,把锁匙直接寄来。
我们虽然拿到锁匙,可是RM400+不见掉!!!
律师已经写信回去,叫他们归还我们的400+,并且偿还超过3天期限交锁匙的interest,4天大约200+
所以说,他们总共欠我们RM600+
如果3天内他们不还钱,律师建议我们去sue seller,在small claim court.

Try to contact the Seller and see how. If it is proven that it was the fault of Seller's lawyer, write to demand the said sum from them, failing which, you wil lodge a complaint to the bar council.

我在想要不要sms给seller一个通知,说我们呈上去small claim court去judge这个问题。
至于找seller谈,上次找他,他说既然我们已经委任律师,就由律师负责。。。
我在等3天期限,就是明天。。。 |

yes u can lodge a complaint against the legal firm, if it is proven that it was their fault. to do so, you have to check with the seller in respect of the true position.

as regards the small claim court, i have not been there, so cant tell.
i think by lodging a complaint in bar council is better, cz they wil be scared if it was truly their fault and refund the monies back to you. |

问题就是他们现在说你有late payment interest 还没还
先和你的律师确认真的你们有pay within period, attach the said letter proving payment etc, to demand back yr money again from the vendor's solicitors. If they still fail to do so, perhaps u can contact the vendor personally, or else directly contact bar council.
我怀疑是vendor's solicitors 自己delay 但是又不要负责,所以把责任转嫁在你的身上
如果是这样就容易
只要你能证明是他们错,complaint to bar council, 他们就会怕,就会退回钱给你了 |
